1. Definitions
- Platform — the BREVET web and/or mobile application, including related communication channels (WhatsApp, SMS)
- Customer — a person requesting tradesperson or home-service work through the Platform
- Tradesperson — a self-employed individual (OSVČ) or company offering services through the Platform
- Job — a specific service request and its fulfillment between a Customer and a Tradesperson
2. Description of Service
BREVET provides a technical platform that:
- Allows Customers to submit a request for tradesperson or home-service work
- Facilitates contact between the Customer and a suitable Tradesperson (based on location, availability, and type of work)
- Facilitates communication between the parties (WhatsApp, SMS)
- Handles payment processing for the Job via a payment gateway (Stripe Connect)
- Allows Customers to rate the service provided after a Job is completed
3. BREVET's Role as Intermediary
BREVET acts as an intermediary within the meaning of Section 2445 et seq. of Act No. 89/2012 Coll., the Czech Civil Code. This means that:
- The contract for work (repair, installation, fitting, etc.) is formed directly between the Customer and the Tradesperson
- The Tradesperson is solely responsible for the proper performance of their services, for compliance with safety and professional standards, and for any warranty on defects in the work
- BREVET is not responsible for the quality, scope, timing, or manner of performance of the Job, nor for any damage arising in connection with its performance
- In the event of a complaint, BREVET remains in communication with both the Customer and the Tradesperson and helps facilitate resolution between the two parties (e.g. relaying information, coordinating a remedy date); legal responsibility for the defect in the work itself rests solely with the Tradesperson
4. Commission and Payments
- The price for the Job belongs to the Tradesperson as the party performing the work
- BREVET handles payment processing for the Job through the Platform, including collecting the full price from the Customer and settling it with the Tradesperson via the Stripe Connect payment gateway
- BREVET retains a commission from each successfully completed Job, the amount of which is stated in the Platform's current price list or communicated to the Tradesperson before the Job is carried out
- The remaining amount, after deduction of the commission, is paid out to the Tradesperson
- BREVET does not store or process payment card numbers — this data is processed exclusively by Stripe
- The commission breakdown is shown transparently before the Job is confirmed
- Payment is accepted exclusively by cashless payment card; the Platform does not accept cash
- After the appointment is confirmed, the Customer securely saves a payment card; no amount is charged at that point
- The final price is charged to the saved card only after the Job is completed and the price has been mutually approved by the Customer and the Tradesperson
- If the Customer does not save a payment card at least 24 hours before the agreed appointment, the Job is automatically cancelled; this payment procedure and its conditions are communicated to the Customer in advance in accordance with Sections 1811 and 1820 of Act No. 89/2012 Coll., the Czech Civil Code
5. Registration and Account
- Using the Platform as a Tradesperson requires registration and the provision of accurate identifying information
- The Tradesperson is responsible for the accuracy and currency of their information (contact details, trade licence, liability insurance where relevant)
- Customers may use the Platform without full registration, depending on the Platform's configuration
- Users are responsible for protecting their account access credentials
6. Ratings and Reviews
- After a Job is completed, the Customer may rate the service provided (a rating, and optionally a written review)
- A review is always tied to a specific completed Job; a review may only be submitted by a Customer for whom the Platform facilitated and actually completed a real Job
- Ratings are displayed publicly at the aggregate level of the BREVET brand; the identity of the individual Tradesperson is not disclosed as part of the public rating
- Reviews arising from a Job provided free of charge or in exchange for a review are clearly labelled „Sponsored Review"
- Ratings must be truthful and must not contain offensive, discriminatory, or unlawful content
- BREVET does not remove a review solely because it is negative; a review may be removed or hidden only where there is demonstrable violation of these Terms or of applicable law
- Ratings are used to inform other users of the Platform and to improve the quality of the intermediated services
7. Communications and electronic messages
- 7.1 By submitting a request via the brevet platform, the customer agrees that BREVET Tech, s.r.o. may send messages relating to the ordered service — in particular booking confirmation, appointment details, payment-card reminders, and other operational notices — to the provided phone number via WhatsApp and SMS, and to the provided e-mail.
- 7.2 These are communications necessary to perform the contract, not commercial (marketing) communications.
- 7.3 If the provided number does not have WhatsApp or the customer does not wish to receive WhatsApp messages, communication takes place by e-mail or SMS.
- 7.4The customer may withdraw consent to WhatsApp messages at any time (by replying "STOP" or contacting info@brevet.cz). This does not affect operational notices necessary to complete an order already placed.
- 7.5 Details on the processing of personal data within this communication are set out in the Privacy Policy.
8. User Obligations
The User agrees that they will:
- Not use the Platform for unlawful purposes
- Provide truthful information about themselves and the requested Job
- Act in good faith towards the other party to the Job
- Not attempt to circumvent the Platform's commission model (e.g. by arranging repeat jobs outside the Platform in order to avoid commission). Where circumvention of the commission model is established, BREVET is entitled to charge the User an additional amount equal to the commission avoided and/or to restrict or fully terminate their access to the Platform
9. Limitation of Liability
- BREVET provides the Platform „as is," without any guarantee of uninterrupted availability or error-free operation
- Before granting a Tradesperson access to the Platform, BREVET carries out a basic verification of the information and documents provided (e.g. trade licence, contact details) as part of its approval process. This verification does not constitute a guarantee of the Tradesperson's professional quality, qualification, or future performance of work
- BREVET is not responsible for any act, omission, or damage caused by a Customer or Tradesperson in connection with the performance of a Job
- BREVET's liability for any damage caused by an error in the Platform is limited to the amount of the commission from the specific Job, unless mandatory law provides otherwise; this limitation does not apply to harm caused intentionally or through gross negligence on BREVET's part
10. Termination and Account Cancellation
- Users may request cancellation of their account at any time at info@brevet.cz
- BREVET reserves the right to restrict or terminate access for a User who repeatedly violates these Terms
11. Changes to These Terms
BREVET reserves the right to update these Terms. Users will be notified of material changes via the Platform or by email. By continuing to use the Platform after a change to these Terms, the User agrees to the updated Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Czech Republic. Any disputes will be resolved by the competent courts of the Czech Republic, unless mandatory legal provisions state otherwise. Consumers may pursue out-of-court resolution of a consumer dispute through the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz) or through the European Union's Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr.
13. Cancellation and Rescheduling
Framework provisions; the specific cancellation and rescheduling terms are communicated to the customer when the appointment is confirmed.
- 13.1 A service order (repair or maintenance) placed via the brevet platform is a contract between the customer and the tradesperson; BREVET Tech, s.r.o. acts as an intermediary.
- 13.2The customer may cancel or reschedule the order free of charge at any time before the tradesperson confirms departure to the customer's location.
- 13.3If the tradesperson confirms departure and the customer subsequently cancels, the customer shall pay a reimbursement of the tradesperson's travel costs in the amount of CZK 700. This amount is reimbursement of actually incurred travel costs and is not a contractual penalty.
- 13.4 The reimbursement under 13.3 is collected by brevet on behalf of the tradesperson and remitted to the tradesperson.
- 13.5For urgent repair or maintenance carried out at a location designated by the customer at the customer's express request, the customer has no right to withdraw from the contract within 14 days under Section 1837(f) of the Civil Code. This does not affect the customer's rights arising from defective performance.
- 13.6 If the tradesperson cancels, no fee is charged to the customer. brevet will make reasonable efforts to arrange a replacement tradesperson and will inform the customer of the outcome.
